The Role of the Mediator

The mediator's role is to remain impartial, identify issues, explore underlying interests and balance power. The mediator does not represent either party and does not make decisions.

The Steps of Mediation
The initial consultation describes the mediation process and outlines the issues that need to be resolved.

The First Mediation Session
Both parties have an opportunity to share their thoughts on the issues, including division of marital property and debt, child and spousal support and devising a parenting plan.

Between Mediation Sessions
The parties compile their financial information and may experiment with different parenting schedules.

Marital Settlement Agreement
The terms of agreement are drafted into a Marital Settlement Agreement. Each party has an opportunity to review this draft on their own. Once final revisions have been made, it is signed by both parties. Then it is filed with the Court and becomes an enforceable divorce judgment.
